Everything you need to know about Spain’s Digital Nomad Visa

In November 2022 the Spanish Government finally approved one of the most hotly anticipated visas of recent times - the digital nomad visa. Now you can live and work in Spain for up to 5 years without the hassle of applying for residency.

 

The purpose of this new visa according to the Ministry of Foreign Affairs, is to “attract talented foreign individuals to Spain,” therefore the visa comes with some handy perks and tax breaks.

Benefits of Spain’s Digital Nomad Visa 

  • It allows you to work in Spain remotely. Unlike other Spanish residency permits such as the Non-Lucrative Visa which bans you from working in Spain, the new digital nomad visa actively encourages applicants to work in Spain.
  • Generous tax breaks for the employee. Digital nomads with this visa will pay significantly less tax than other tax residents in Spain. This works out as a flat tax rate of only 15% on the first €600,000 in gross annual earnings over a five-year period. 
  • Allows you to legally override the 90/180-day rule that limits your stay in Spain (and by extension the Schengen Area/EU).
  • Tax breaks for the foreign employer (if they have an office in Spain)

How to apply for a Spanish digital nomad visa

To apply you must ensure you have all the documents listed below. Residence and work visa applications must be submitted in person to BLS INTERNATIONAL CENTRE and NOT the Consulate.  An appointment is necessary. Appointments are only for one person and passport, additional family members will need a separate appointment, including minors. 

Requirements for individuals 

  • Fill out and sign the visa application form
  • Pay the visa fee 
  • Valid passport
  • A recent, passport-size photo 
  • Criminal records certificate
  • NIE number prior to visa application
  • Proof of health insurance
  • Proof of financial means - must be at least 200% of the monthly Spanish national minimum wage (approximately £2,140 per month or £25,700 per year).
  • Applicants must have an undergraduate or postgraduate degree, or have at least 3 years of work experience in their current area of work. 
  • If you’re an employee, you’ll need to provide certification that you have been working for your company for at least 3 months (before the visa application), including length of contract and consent from your employer to work remotely in Spain. 
  • If you’re self-employed you will need a certificate issued by Companies House, declaring the start date of your company (or companies) and its nature of business.

Requirements for couples/families 

All of the above applies, plus:

  • If you’re moving with a family member(s); the first family member (usually the partner/spouse) must prove additional financial means of at least 75% of the Spanish minimum wage (approximately £800 per month or £9,600 per year).
  • For each additional applicant, 25% of the Spanish national minimum wage is required (approximately £270 per month or £3200 per year).
  • Any of the following means of proof are acceptable: work contract, bank statements, payslips etc.
  • Documents proving family relationship with the worker: birth or marriage certificates issued by the civil registry, certificate of registration as an unmarried couple etc. All documents must be legalised and translated into Spanish. 

Other things to be aware of

  • If the applicant is self-employed, they can also work for a company located in Spain, as long as the percentage of this particular work does not exceed 20% of the total amount of their professional activity.
